Terms of Service
1. Agreement to Terms
By accessing or using Autograph (operated by The Autograph App), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use the service. These terms apply to all users of the platform, including document senders and signers.
2. Description of Service
Autograph is an electronic signature platform that allows users to upload PDF documents, place signature fields, and send signing requests via email. Signers receive a secure, single-use link to review and sign documents without creating an account. Completed documents are sealed with embedded signatures and a legal certificate of completion.
3. Accounts and Authentication
To send documents for signing, you must create an account using your email address. Authentication is handled via magic link (passwordless login). You are responsible for maintaining access to the email address associated with your account. You may not share your account or allow others to access it on your behalf.
4. Free and Paid Plans
Free accounts include 1 agreement credit. Additional credits may be purchased individually. Each credit is consumed when you send an agreement for signing, regardless of the number of signers. Unlimited and Lifetime plans provide unlimited agreements. All plans include every feature — paid plans simply remove the credit limit.
Unlimited subscriptions are billed monthly or annually and may be cancelled at any time through the Stripe customer portal. Lifetime plans are a one-time purchase with no recurring charges. Refunds are handled on a case-by-case basis. All prices are in US dollars.
5. Electronic Signatures
Autograph facilitates electronic signatures that are intended to be legally binding under the US Electronic Signatures in Global and National Commerce (ESIGN) Act and Canada's Uniform Electronic Commerce Act (UECA). However, The Autograph App does not guarantee that any specific agreement will be enforceable in any jurisdiction. You are responsible for determining whether an electronic signature is appropriate for your specific use case.
Autograph is not a substitute for legal advice and should not be used for documents requiring notarization, witness signatures, or other formalities beyond a standard electronic signature.
6. Document Storage and Security
All uploaded documents, signature images, and completed files are stored on servers located in North America. Documents are fingerprinted at upload and after sealing to detect tampering. A complete audit trail is maintained for every document, recording actions such as upload, viewing, consent, signing, and sealing.
Documents are retained indefinitely unless you delete them. We do not access, review, or share the contents of your documents except as required by law or as necessary to provide the service (for example, to embed signatures into the PDF).
7. Signer Responsibilities
By signing a document through Autograph, signers consent to the use of electronic records and signatures and acknowledge that their signature, email address, IP address, and timestamp will be permanently recorded for legal purposes. Signers do not need to create an account to sign.
8. Acceptable Use
You may not use Autograph to:
- Upload documents containing protected health information (the service is not HIPAA compliant)
- Send fraudulent, deceptive, or illegal documents for signing
- Impersonate another person or entity
- Interfere with or disrupt the service or its infrastructure
- Attempt to access other users' documents or accounts
- Use the service for bulk or automated signing operations not intended by the platform
9. Intellectual Property
You retain full ownership of all documents you upload to Autograph. We do not claim any rights to your content. The Autograph name, logo, and platform are the property of The Autograph App.
10. Limitation of Liability
The Autograph App provides Autograph on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the service's reliability, availability, or fitness for a particular purpose. To the maximum extent permitted by law,The Autograph App shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
Our total liability for any claim related to the service shall not exceed the amount you paid to The Autograph App in the 12 months preceding the claim, or $100, whichever is greater.
11. Termination
We reserve the right to suspend or terminate your account if you violate these terms or engage in conduct that we determine is harmful to other users or the service. You may delete your account at any time. Upon termination, your documents and associated data will be deleted, though audit records may be retained as required for legal compliance.
12. Changes to These Terms
We may update these terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the service. Your continued use of Autograph after changes take effect constitutes acceptance of the updated terms.
